Inspection Terms & Conditions
1. Definitions
Build Code QA, we, us and our mean the Build Code QA business providing the service. Client and you mean the person or entity named in the booking. Service means the inspection, reinspection, supervision, advisory work or other service confirmed in writing.
2. Online Booking Request
The online booking portal allows you to select a service, enter project details and view the applicable professional fee and amount payable at that stage.
A preferred inspection date is a request only. Submission of the form or payment does not guarantee a particular date, time or attendance window until Build Code QA confirms the booking.
You must provide complete and accurate information. We may seek clarification, decline a request or adjust the scope and fee where the information supplied is materially incomplete or incorrect.
3. Formation and Booking Confirmation
A booking is confirmed only when:
- the online booking request has been submitted;
- the Inspection Agreement and these Terms & Conditions have been accepted;
- the amount required through the booking portal has been successfully paid; and
- Build Code QA has accepted the request and issued confirmation.
If we cannot accept the requested service or date, we will contact you to arrange an alternative or refund any amount received for a service that will not proceed.
4. Professional Fees
The fee displayed during booking is based on the selected service and the project information entered, including factors such as inspection stage, dwelling type, number of storeys, floor area, location and agreed scope.
The confirmed fee applies to the stated scope and one attendance per booked inspection stage unless expressly stated otherwise.
Additional services, variations, meetings, document reviews, supplementary reports, return visits, reinspections or attendances outside the confirmed scope may be quoted and charged separately.
5. Payment
The amount payable during booking will be displayed before you proceed to the nominated secure payment provider. Payment-card details are processed by that provider and are not entered into the Build Code QA booking form.
Any outstanding amount, reinspection fee, travel charge or additional service must be paid by the due date shown on the relevant invoice or payment request.
Build Code QA may withhold attendance or delivery of work not yet supplied until an overdue amount for that service has been paid.
6. Travel
A travel surcharge may apply to sites located more than 70 kilometres from Golden Grove, South Australia. Any applicable charge will be disclosed or agreed before the affected attendance.
7. Client Responsibilities
You are responsible for:
- providing accurate contact, project, builder and site information;
- obtaining permission for Build Code QA to access the site;
- providing relevant drawings, specifications, engineering and variations;
- ensuring the nominated construction stage is ready and reasonably accessible;
- notifying us promptly of changes to the program, site or required service; and
- paying confirmed fees when due.
8. Site Access, Readiness and Abortive Attendance
Where access is unavailable, the site is unsafe, the stage is not ready, relevant work has been concealed, or the attendance cannot reasonably proceed for reasons outside our control, the booked attendance may be treated as used.
Before charging for a further attendance, Build Code QA will explain the reason and advise the applicable additional fee. This does not affect any rights you may have under the Australian Consumer Law.
9. Cancellations and Rescheduling by the Client
Please give as much notice as reasonably possible if the project program changes. We will make reasonable efforts to reschedule the attendance.
Where late cancellation or rescheduling causes a reasonably incurred loss, including committed travel or an unusable inspection appointment, Build Code QA may retain or charge a reasonable amount reflecting that loss. Any balance not reasonably required will be refunded.
10. Rescheduling by Build Code QA
Build Code QA is a specialist service operated by a single inspector. Attendance may need to be rescheduled because of illness, urgent personal circumstances, weather, unsafe conditions, travel disruption, workload or another event beyond reasonable control.
We will provide notice as soon as reasonably practicable and offer the earliest reasonable alternative. If no suitable alternative can be agreed for a service not yet supplied, you may cancel that service and receive a refund of the amount paid for it.
11. Availability and Construction Programs
We do not guarantee same-day, next-day, emergency or fixed-time attendance unless expressly confirmed in writing.
The client and builder remain responsible for the construction program. Build Code QA is not engaged as the builder, superintendent, certifier or construction programmer.
12. Reports and Delivery
Reports are generally delivered electronically to the client using Google Drive, email or another reasonable electronic method selected by Build Code QA.
You are responsible for downloading and securely retaining reports and related records provided to you.
13. Reliance and Third Parties
The report is prepared for the client named in the booking for the purpose of the confirmed service. A third party must not rely on it without Build Code QA's prior written consent.
You may provide the report to your builder, designer, engineer, lawyer or other adviser for your project, but doing so does not create a duty or contractual relationship between Build Code QA and that recipient.
14. Intellectual Property
Build Code QA retains ownership of its report formats, inspection systems, templates and general know-how. Once the relevant fee is paid, the client may use and reproduce the completed report for the project and purpose for which it was commissioned.
15. Consumer Law and Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
Subject to those non-excludable rights, Build Code QA is responsible for direct loss caused by its failure to exercise reasonable care and skill in supplying the confirmed service.
To the extent permitted by law, Build Code QA is not responsible for loss caused by concealed or inaccessible conditions, inaccurate or incomplete information supplied by others, changes made after attendance, failure to obtain specialist advice where recommended, or use of a report outside its stated purpose.
Where the law permits a remedy to be limited, Build Code QA may elect to resupply the affected service or pay the reasonable cost of having that service supplied again.
16. Complaints and Corrections
If you believe the service or report contains an error, please contact Build Code QA promptly and provide details. We will review the concern and, where reasonably required, correct or clarify the report or propose another appropriate remedy.
17. Privacy
Personal information is handled as described in the Build Code QA Privacy Policy. Payment information is handled by the nominated payment provider under its own privacy and security arrangements.
18. Electronic Acceptance
You accept these terms and the Inspection Agreement by completing the electronic acknowledgements in the booking portal and proceeding with the booking.
Build Code QA may retain the booking ID, client details, date and time of acceptance, document version and payment record as evidence of the agreement.
19. Changes to These Terms
Updated terms apply only to bookings made after the updated version is published, unless a change is separately agreed in writing. The version accepted for an existing booking continues to apply to that booking.
20. Governing Law
These terms are governed by the laws of South Australia. The parties submit to the courts and tribunals having jurisdiction in South Australia, subject to any law that provides otherwise.
